NACPA Wins Appeal: Appellate Court Vacates Unreasonable BMI Royalty Decision

NACPA and its members are gratified that the appellate court has granted NACPA’s appeal and vacated the trial court’s decision. We are pleased that the appellate court recognized that both the royalty rate set by the district court and the expansion of the revenue base to which that rate was applied were unreasonable and require adjustments. This is a great result for performing artists—who bear the brunt of the royalty costs paid to BMI for live concerts—and for concertgoers and the live concert industry.
